COMPLAINTS AND RETURNS

Returns:

Pursuant to the Consumer Rights Act of 30 May, 2014 (Journal of Laws of 2914, item 827), the Consumer may withdraw from the agreement without naming any reason within 14 days from the date of receiving the package. The period for withdrawal shall be deemed to have been observed if the declaration has been sent before its expiry (e.g. the letter has been sent by post or e-mail). The form of agreement withdrawal declaration. A Buyer who is not a Consumer can return purchased foods within a non-negotiable deadline of 14 (fourteen) days from the delivery date, but the decision on accepting such a return shall be made exclusively by RGB.

Return of goods as a part of withdrawal from the agreement is possible if:

  • returned goods are complete;
  • goods are returned unaltered, save when the modification was necessary in the ordinary course of business, i.e. the Consumer should handle the goods, taking into account the possible necessity of their later return;
  • returned goods were not ordered at Client’s express individual request;

In case of purchase cancellation, returned goods together with an agreement withdrawal declaration shall be send back to the following address:

IMPORTANT:

  • The cost of sending the goods back shall not be reimbursed. RGB does not accept any COD packages sent to it;
  • The equivalent of goods value resulting from purchase cancellation shall be returned to the Consumer immediately after the receipt of the package, no later than within 14 days. The return of payment shall be made pursuant to § 9 of the Terms and Conditions (Return of financial resources);
  • The acceptance of return is only guaranteed when the package is property secured and protected;

When the decision is made to accept the return of goods from a Client who is not a Consumer (hereinafter referred to as the Buyer), RGB shall reimburse the Buyer with an amount equal to the price paid by the Buyer for the goods, reduced by 20% (twenty percent) of this price charged on account of costs incurred in relation to the returned products verification. Above indicated value that arises from purchase cancellation shall be returned to the Client immediately after the receipt of the package, no later than within 14 days. The return of payment shall be made pursuant to § 9 of the Terms and Conditions (Return of financial resources);

Complaints:

If received goods are defective, the Client is entitled to execute the rights specified in the product guarantee.

The Consumer can also submit a complaint (in the Shop) resulting from warranty. In case of finding a defect of goods, the Consumer is entitled to file a complaint within 2 (two) years from the date of goods delivery and 1 year from having found the defect of goods.

WARRANTY

  • 1. The Seller is responsible to the Client if the sold goods have a physical or legal defect, but:
    • a. the physical defect shall be understood as a nonconformity of goods with a sales agreement, in particular if the goods:
      • do not have properties required for the goods of this type to serve their purpose specified in the sales agreement or resulting from circumstances of their intended use,
      • do not have properties of which the Seller ensured the Client,
      • have been delivered incomplete to the Client
    • b. the legal defect shall be understood as a nonconformity of goods with a sales agreement, in particular if the goods:
      • are a property of the third party,
      • are encumbered with third party’s rights,
      • can be used or managed to a limited extent as a result of a decision or a statement of an applicable authority.
  • 2. The loss or damage of goods of which the Client has been informed before the purchase, and if Client has agreed to have the product to be sent in this condition, shall not constitute a physical defect.
  • 3. In case of finding goods incompliant with the agreement, the Client has a right to file a complaint in the Shop. The complaint can be filed: in person, by phone, by a registered mail, or by e-mail at: [email protected]. Such right shall apply within 2 (two) years from the delivery of goods.
    In such a case, the Client can send the goods back by post economy mail to the Shop’s address for deliveries: RGB Elektronika Spółka z Ograniczoną Odpowiedzialnością Sp. K. ul. Długosza 2-6, bud. 2, 51-162 Wrocław.
  • 4. In order to allow for the processing of the goods-related complaint, the Client should send or deliver claimed goods with their proof of purchase from the Seller (such as a receipt, invoice, proof of payment for a specified Order).
  • 5. The complaint should include at least a first and last name, an e-mail address used by the Client when placing the order, a specification of claimed goods, a description of expressed reservations, and Client’s request related to the filed complaint. Complaints filed in writing should also include the Client’s contact address. When the above mentioned data is missing, the Seller can ask the Client to complement such data.
  • 6. In the scope of complaint the Client can request:
    • a. goods to be repaired;
    • b. goods to be replaced with other goods free of defects;
    • c. lowering the price;
    • d. withdrawal from the agreement – if the defect is significant.
  • 7. The Client can file a complaint within a year from the day when the defect was found. The deadline for filing a complaint cannot end earlier than after a two-year period of the Seller’s responsibility for the goods.
  • 8. Within 14 business days, the Seller shall address the goods complaint filed by the Client, and shall inform the Client about further procedures.
  • 9. The Seller shall not be responsible for any physical defect of goods resulting from an improper installation or commissioning of goods, when such actions were not performed by the Seller or by the Buyer who acted in accordance with the instruction provided by the Seller.
  • 10. If the complaint is accepted, the Seller shall reimburse the Client for all costs related to sending back the claimed goods, and shall cover the cost of resending the goods to the Client. The return of costs shall be conducted pursuant to the rules specified in § 9 of the Terms and Conditions (Return of financial resources).

GUARANTEE

The guarantee is granted for selected products. Within the scope of the guarantee, the claimed goods shall be repaired, pursuant to the guarantee-specified conditions, by RGB Elektronika Spółka z Ograniczoną Odpowiedzialnością Sp. K.

IMPORTANT:

  • The Client has a right to check the condition of a package in the courier’s presence.
  • In case of damaged or tampered packaging, the damage protocol shall be prepared before the courier or post office official. In case of finding a damage that is invisible from the outside, the Client can report this situation to the carrier company or the Seller within 7 days. The damage protocol sent to the shop with a complaint will facilitate complaint processing.
