Providing personal data, as well as consent to their processing are completely voluntary. All personal data provided to us are processed only to the extent and for the purpose for which you have agreed. However, if you decide not to provide us with the necessary data to process the order and you do not agree to their processing, unfortunately we will not be able to process your order.

Please, bear in mind that we respect your right to access, correct, request deletion or request restriction of our usage of your personal information as required by applicable law. However your withdrawal of consent does not affect the data processing carried out by the Administrator in accordance with the law before the withdrawal.  You can access, modify or delete your personal details from our system on your own, as well as using our help, which we will gladly provide.

We assure you that our company adheres to a restrictive personal data security policy. Your personal data are  safe with us and we make every effort to increase your data protection standards year by year.

I. Who is the administrator of personal data?

The Administrator of your personal details hereinafter referred to as “Administrator” responsible for safety of your personal details is:

II. How do we protect your personal details?

The Administrator has implemented internal procedures in line with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free transfer thereof and repealing Directive 95/46 / EC. The abovementioned procedures ensure effective protection of your personal data.

III.    What kind of personal data do we request and why?

A. Registration

During the registration, process the Administrator asks for the data necessary to set up an account in the online store RGB so that the Customer will not have to refill the entire order form with each subsequent purchase which means saving their time. Registered customer after logging in can also verify the status of their order and the history of purchases made. The user registered and logged into our system can correct, complete or delete their personal details from our system.

While registering to our system our Customers are requested to provide us with the following data:

  1. first name and surname used for issuing the invoice and addressing the shipment with purchased goods;
  2. e-mail address which is also used as their login logging into our system and handling the  communication related to their orders.
  3. password indispensable for logging into our system.

After creating their account, the Customer can add their phone number, default delivery address (street, house number / or house and flat number, zip code, city, state, country) addressing the shipment with purchased goods as well as company name and their Tax Identification Number (VAT EU) - we need later to issue an invoice. Another option available on the account of the registered customer is to add their basic billing address (street, house number / or house and flat number, zip code, city, state, country), as well as company and their Tax Identification Number (VAT EU) and telephone number. These data are particularly necessary in the case when the payer is another person / company than the ordering party and will be used to issue an invoice and send it to the indicated person or company.

Data provided during registration are processed only by the online store and are not used in any other way, nor are they transferred to other entities, including third countries or international organizations.

B. Placing an order

While placing an order our Customers are requested to provide us with the data necessary to process their order, which in the case of registered and logged in Customers are partially automatically retrieved from the data provided during their registration process.

For the order processing purpose following data are requested by us:

  1. first name and surname used for issuing the invoice and addressing the shipment with purchased goods;
  2. the address of the company head office (the street name, the number of the company building or office room, zip code, city and country used for issuing the invoice
  3. e-mail address used for handling the  communication related to our Customers’ orders.
  4. telephone number which is particularly required by the forwarder in case of choosing certain delivery methods
  5. Tax Identification Number NIP (VAT EU) number indispensable for issuing the invoice

In case when the Customer wants their order to be delivered to another address than the address defined in the registration process following data will be required:

  1. first name and surname or company name of the party receiving the shipment used for addressing the shipment;
  2. the address of the party receiving the shipment (the street name, the number of the company building or office room, zip code, city and country) used for addressing the shipment;
  3. telephone number of the party receiving the shipment required by the forwarder in case of choosing certain delivery methods
  4. Tax Identification Number NIP (VAT EU) number necessary for issuing the invoice

In case when the Customer wants their invoice to be issued to another address than the address defined in the registration process following data will be required:

  1. first name and surname or company name of the invoice payer;
  2. the address of the invoice payer (the street name, the number of the company building or office room, zip code, city and country) used for issuing the invoice;
  3. telephone number of the party receiving the shipment required by the forwarder in case of choosing certain delivery methods
  4. Tax Identification Number NIP number necessary for issuing the invoice

The details provided by the Customer while placing their order are processed by the online store and the following parties in the following scope:

1. first name, surname, address, telephone number and e-mail defined by the Customer as their delivery address are transferred to the forwarder cooperating with the Administrator in the form of the address label / packing list which are interpreted by the forwarders as the confirmation of ordering their services depending on the delivery method chosen by the Customer

2. first name, surname, address, NIP (VAT UE) of the invoice payer indicated by the Customer as the invoicing details are transferred in the form of the invoice to the Administrator’s accounting system SUBIEKT.   

If you use the payment with the use of an external payment system, all data given after switching to the website of each payment operator remain registered only in their database and are not in any way available or stored by the online store.

The online store cooperates with the following payment operators -  PayPal and First Data (secure online payment).

C. Subscription to the newsletter

The Customers who have subscribed to the newsletter and agreed to receive it in the registration process or activated this option in their account are requested only to provide their e-mail address for  commercial communication (marketing, advertising, promotional materials) from the Administrator. The Customers may cancel their subscription to the newsletter at any time.

D. The diagnostic order

The Customers who place an order for carrying out the diagnostics of their equipment are requested for the following details:

  1. first name, surname and company name used for issuing the invoice and addressing the shipment with equipment subject to diagnostics;
  2. telephone number of the person to be contacted by the employees in charge of diagnostics in case of additional questions asked  to ensure correct realisation of the diagnostics order and / or required by the forwarder in case of choosing certain delivery methods
  3. email address of the person to be contacted by the employees in charge of diagnostics in case of additional questions asked  to ensure correct realisation of the diagnostics order and / or required by the forwarder in case of choosing certain delivery methods
  4. Tax Identification Number NIP (VAT EU) used for issuing the invoice
  5. the address of the company head office necessary for issuing the invoice
  6. the delivery address for addressing the shipment with the equipment subject to diagnosis

If the email address of the person in charge of processing the payment for diagnostics services is different from the email address provided while placing a diagnostic order the Customer is requested to provide also the email address required for invoicing purpose.

E. Phone contact requests

The Customers who have asked for a telephone conversation with our service by choosing the option “Phone Contact Request” are requested to provide their phone number. In the case of a telephone conversation, we also process the recording of your voice.

IV.    Personal details collected automatically from the user entering the online store website.

A. Server

The Administrator’s IT system automatically collects in its logs the details of the device used while connecting to the online store. These data relate to IP, addresses of the source sites where the files were downloaded from, the output address and are used only for diagnostic and statistical purposes of the online store.

These data are never combined with the data referred to in the part III hereof and are only material for statistical analysis and system error correction mechanisms.

B. Cookies

The online store uses the technology of cookies, which are text files placed on the devices interacting with our website for technical purposes of the connection session.

 V. Who are your personal data shared with

The Administrator selects their business partners with due care and verifies the links to other websites posted on RGB online store website as well as the privacy policies of these websites. Nevertheless, the Administrator is not responsible for the standard and privacy protection policy applied by owners, operators or administrators of these websites. That is why we recommend that each of our Customers verify and decide on their own whether they want to entrust their personal data to these other websites.

The Administrator also shares the details of their Customers to the payment operators and forwarders indicated in the paragraph III B hereof.

The personal data of the Customers are also transferred to service providers which the Administrator cooperates with for running the online store. The providers of these services are processors, which means they process the personal data entrusted to them by the Administrator and are subject to the Administrator’s orders in this regard as to the purposes and methods of data processing. They are providers of IT, on-line marketing and email sending services. The abovementioned suppliers are the entities based mainly in Poland who guarantee a high level of personal data protection and have signed contracts with the Administrator regulating the way of processing the personal data entrusted to them.

In special situations the Administrator may provide the collected data to authorized state authorities if that is required by the applicable law. Except for these situations, the personal details of the Customers will only be disclosed to the extent, purpose and entities listed in this privacy policy.

The Customers’ details may be also made available to the other members of RGB group including:

  1. RGB Automatyka Sp. z o.o. based in Wroclaw, Jana Długosza Street 2-6 (KRS: 0000480438)
  2. RGB Marketing Sp. z o.o. based in Wroclaw, Jana Długosza Street 2-6(KRS: 0000638502).

These companies cooperate with the Administrator and are in charge of providing certain services to the customers. They process the Customers’ personal details only in the scope necessary for completing the tasks assigned to them by the Administrator and do it under the Administrator’s instruction.

VI. How long is your personal information stored in our system

The details provided to the Administrator by the Customer are stored for the time of:

  1. registration in the online store for the purpose of maintain all functionalities of the Customer’s account,
  2. subscription to the newsletter for marketing purposes
  3. telephone conversation with Customer Service in case using “Phone Contact Request” by the Customer

In the event of receiving the Customer’s request to delete their account, unsubscribe from the newsletter, end the phone call, the data provided by the Customer will be deleted by the Administrator. The Administrator will not, however, delete the data necessary for the purposes of handling any complaints and claims related to the sale of goods or the data collected by the Administrator's services for archival, statistical and analytical purposes. Reassuming, the Administrator will not store the Customer’s personal data longer than necessary but only for the time and in the scope required by applicable law and for the purpose of protecting the Customer and the Administrator.

VII. How can the Customers execute their rights related to processing their personal details

  1. The right to withdraw the consent to data processing by the Administrator

You have the right to withdraw any consent you gave when you registered your account or subscribed to the newsletter but it has the effect since the moment it was made. The withdrawal of consent does not affect the data processing carried out by the Administrator in accordance with the law before the withdrawal was made. The withdrawal of consent does not entail any negative consequences for you. However, it may prevent you from continuing to use the services or functionality that we can legally provide only with your consent.

  1. Right to object to the processing of your personal data by the Administrator

You have the right to object to the processing of your personal data at any time.

The discontinuation of your newsletter subscription will mean our opposition to our processing of your personal data. If your opposition turns out to be well founded and we have no other legal basis to process your personal data, we will delete the data for whose processing you objected

  1. Right to remove your personal details

You have the right to request removal of all or some of your personal data. We will treat the request to delete all personal data as a request to delete your account and discontinue your subscription to the newsletter.

You have a right to request removal of your personal details from our system if:

a)       You have withdrawn your consent to process your personal details which have been processed based on your consent;

b)      Your personal details are no longer necessary for the purpose which they have been collected for or processed;

c)       You have objected to use your personal details for marketing purposes;

d)      Your personal details are processed in illegal way

Despite your request to delete your personal data, raised as the opposition or withdrawal of consent to data processing, we may retain certain your personal data to the extent necessary to establish, assert or defend claims.

  1. Right to restrict your data processing

You have the right to request a restriction on the processing of your personal data. If you submit such a request, we will prevent you from using certain functionalities or services which need the data whose processing you want to restrict until we process your data restriction request.

You have the right to request restrictions on the use of your personal data in the following cases:

a)       your personal information stored in our system is incorrect;

b)      your data are  processed in unlawful way;

c)       Your personal details are no longer necessary for the purpose which they have been collected for or processed but are still necessary to establish, assert or defend claims;

d)      You have objected to use your personal details. In this case, the restriction is made for the time needed to consider whether, due to your special situation, the protection of your interests, rights and freedoms outweighs the interests that we pursue by processing your personal data.

  1. Right to access your personal details

You have the right to obtain confirmation from us whether we process your personal data, and if this is the case, you have the right to:

a)       access your personal details;

b)      obtain information about the purposes of processing, categories of personal data being processed, the recipients or categories of recipients of this data, the planned period of storage of your data or criteria for determining this period, about your rights under the GDPR and the right to lodge a complaint to the supervisory authority, the source of these data, on automated decision-making, including profiling and safeguards applied while transferring these data outside the European Union;

c)       obtain the copy of your personal details

  1. Right to correct your personal details

You have the right to correct and complete your personal data with additional information. You can do this by submitting a request to correct the data (if incorrect) and to complete them with additional information (if incomplete).

You have the right to receive your personal data that you provided to us and then send them to another personal data administrator of your choice. You also have the right to request your personal data to be transferred by us directly to such other administrator, if it is technically possible.

If, by exercising the aforementioned rights, you submit a request to us, we comply with this request or refuse to comply with it without a delay, but no later than one month after receipt. However, if - due to the complexity of the request or the number of requests - we will not be able to meet this deadline, we will process your request within the next two months, informing you in advance about postponing the deadline.

You are entitled to lodge your complaints about the way your personal data are processed and your rights related to your personal details are respected.

If you believe that our obligations under the provisions of the General Data Protection Regulation have been neglected or your rights granted thereunder have been violated, you have the right to lodge a complaint with the supervisory body - the Data Protection Officer (previously referred to as the Inspector General for Personal Data Protection).

V. Privacy policy of Administrator’s business partners

The Administrator selects their business partners with due care and also carefully verifies the links to other websites posted on RGB online store website and privacy policies of these websites. The administrator is not responsible for the standard and privacy protection policy applied by owners, operators or administrators of these websites. That is why we recommend that each of our Customers verify and decide on their own whether they want to entrust their personal data to these other websites

VI. Sharing your personal details with third parties

In special situations the Administrator may provide the collected data to authorized state authorities if that is required by the applicable law. Except for these situations, the personal details of the Customers will only be disclosed to the extent, purpose and entities listed in this privacy policy.

VII. Modifications of Privacy Policy 

The Administrator reserves the right to change their privacy policy, if it is required by applicable law, change in store operation technologies or in case when the intended modification will introduce a higher standard than the minimum required by law.

The shop will inform about such a change by email (to the e-mail address provided during registration). The notification will be sent at least 30 days before the new privacy policy enters into force.
