RGB Elektronika Spółka z ograniczoną odpowiedzialnością Sp. k.Guarantee Conditions

  • 1. The following definitions contained in these Guarantee Conditions shall have the following meaning:
    • a) “Guarantee” means the rights and obligations resulting from these Guarantee Conditions and the provisions of the Civil Code;
    • b) “Guarantee Card” means a document including these Guarantee Conditions;
    • c) “Device” means a device, whose name, model, and manufacturer’s serial number have been specified in the content of this Guarantee Card, and a device that is free of defects, which the Person entitled by the Guarantee has received as a replacement for the defective Device, unless the Guarantee Conditions expressly provide a different meaning of this term;
    • d) “Guarantor” means RGB Elektronika Spółka z ograniczoną odpowiedzialnością Sp. k. ul. Długosza 2-6, 51- 162 Wrocław.
    • e) “Seller” RGB Elektronika Spółka z ograniczoną odpowiedzialnością Sp. k. ul. Długosza 2-6, 51- 162 Wrocław.
    • f) “Force majeure” means any extraordinary external event, which cannot be prevented or influenced by the Guarantor performing or intending to perform a guarantee repair of the Device, which includes, but is not limited to riots, strikes, group disputes, military conflicts, and natural disasters;
    • g) “Repair” means specialized actions intended for the removal of the Device defects covered by the Guarantee, performed by the Guarantor on the basis of one report of the necessity to repair the Device, regardless of how many spare parts have been used in order to complete such actions, with reservation that such a term does not cover actions related to the installation and maintenance of the Device and prescribed in the device’s manual, regulation of the Device;
    • h) “Person entitled by the Guarantee” means a person who purchased a Device from the Seller, and any further owner of the Device and holder of the Guarantee Card, who has acquired an effective right to execute the rights resulting from a Guarantee.
  • 2. Guarantor shall grant a Guarantee of a proper functioning of the Device for 24 months from the date of a sale specified in the Guarantee Card. Guarantee shall apply on the territory of the Republic of Poland. The Guarantee Period shall be extended by a period starting on the day of reporting the necessity to perform a Repair of the Device by the Guarantor, mentioned below in section 4, and ending on the day when the Person entitled by the Guarantee is notified by the Guarantor that the Repair has been finished. If, as a result of performing the obligations arising from these Guarantee Conditions, the Person entitled by the Guarantee has received a Device that is free of defects (as a replacement for the defective Device), or if two Important Repairs have been made, the above specified Guarantee period shall start anew from the moment of receipt of the Device free of defects by the Person entitled by the Guarantee, or from the moment of performing the last Important Repair of the Device.
  • 3. A necessity to perform a Repair of a Devices shall be reported to the Guarantor.
  • 4. Reporting the necessity to perform a Repair of a Device, the Person entitled by the Guarantee shall first agree with the Guarantor on the method of transferring the Device for Repair. The necessity to perform a Repair can be reported: in person, by phone, by a registered mail, or by e-mail at: [email protected].
  • 5. If agreed that the Device will be picked up by the Guarantor, the Device should be picked up within 14 days from the day when the Person entitled by the Guarantee reports the necessity to perform a Repair. In case of failure to observe this deadline by the Guarantor, the Person entitled by the Guarantee will be able to deliver the Device at the Guarantor’s cost. If it is impossible to reach such an agreement or in case of doubts regarding the content of such agreement it shall be assumed that the Device will be delivered to the Guarantor by the Person entitled by the Guarantee at the Guarantor’s cost, with reservation that the delivery cost cannot exceed PLN 30.75.
  • 6. Repair of Device defects covered by the Guarantee shall be performed within 30 days from the day of delivering the Device to the Guarantor or the Device receipt by the Guarantor. Removal of Device defects covered by the Guarantee shall be conducted free of charge within a Guarantee period. In the Guarantee period, the Person entitled by the Guarantee shall not bear any costs related to the Service Point’s receipt and the delivery of the Device subject to the Repair.
  • 7. Parts replaced during the Repair performed by the Guarantor shall be brand new, exclusively in case of a new Device, and shall be a strict equivalent of the parts that are subject to replacement.
  • 8. Guarantor shall not be responsible for any breach of deadlines for performing the Repair and picking up or delivering the Device subject to Repair if the delay in actions is caused by force majeure, the lack of spare parts on the territory of the Republic of Poland; import/export-related restrictions regarding devices and spare parts; unexpected circumstances that make the repair impossible; the time needed to verify the defect.
    In such a case these deadlines shall be extended by a period indicated by the Guarantor.
  • 9. The Guarantor is obliged to deliver the Device to the Person entitled by the Guarantee after the Device has been repaired. The Device should be delivered to the Person entitled by the Guarantee within 7 days from the completion of the Repair. A detailed deadline (with specified day and time) for the delivery of the Device by the Guarantor shall be agreed upon jointly by the Person entitled by the Guarantee and the Guarantor. The Person entitled by the Guarantee is obliged to pick up the Device with removed defects covered by the Guarantee and delivered by the Guarantor within such agreed deadline. Otherwise, the Person entitled by the Guarantee shall bear the costs of a re-delivery of the Device by the Guarantor; however, the deadline for the re-delivery shall not be longer than 7 days from the day of Repair completion, and shall be determined by the Service Point.
  • 10. The Guarantor shall perform the Device Repair on condition that the Person entitled by the Guarantee presents their Guarantee Card including Device name and model, sale date, Device buyer’s name, and a Seller’s name. The Seller is obliged to complete this above data (when not entered when the Guarantee Card was issued for the Device buyer), as well as to issue a duplicate Guarantee Card (in case of its loss or damage by the Person entitled by the Guarantee) on the basis of a bill or receipt (constituting—by referring to the type—a proof of Device sale by the Seller) presented by the Person entitled by the Guarantee.
  • 11. Device that requires a professional installation to the electrical grid, water, sewage, and gas systems can be connected only by persons with necessary qualifications in this area. Otherwise the Guarantee rights shall be lost. The Guarantor can make the Repair dependent on whether the Person entitled by the Guarantee presents the proof of compliance with this requirement.
  • 12. The Devices shall be used in accordance with its intended use. Any Device repairs performed by any persons other than the Guarantor lead to the loss of Guarantee rights.
  • 13. Guarantee does not cover:
    • a) damages of the Device caused by its users as a result of improper usage or using the Device in a way incompliant with the Device instructions for use, which also applies to the Device installation and maintenance;
    • b) damages of the Device caused by its usage outside of its intended use;
    • c) damages of the Device caused by improper installation or an installation that is non-compliant with the instructions for use, including installation performed by persons without necessary qualifications (certificates) in this area;
    • d) damages of the Devices caused by using improper consumables;
    • e) maintenance operations specified in the instructions for use;
    • f) damages of the Device as a result of its repair by other persons than the Guarantor;
    • g)alterations or construction changes of the Device introduced by other persons that the Guarantor;
    • h) damages of the Device caused by external factors (lightings, incorrect operation of electrical grid, water, sewage, and power supply systems);
    • i) damages of the Device as a result of its insufficient security during the Device transfer by the Person entitled by the Guarantee to the Guarantor;
    • j) glass parts or light bulbs.
  • 14. In case of unjustified request to perform the Repair, the Person entitled by the Guarantee (or the Device user, who has lost Guarantee rights) shall cover all costs related to the delivery of the Device to the Guarantor, Device repair and receipt, and in case of the Device repair at user’s site, the repair cost and transport expenses of the Guarantor’s employees to the site where the Device will be repaired. Unjustified request to perform the Device Repair shall include in particular: a request to repair damages or perform maintenance (installation) operations not covered by the Guarantee, as well as the request to perform a Repair in spite of having lost the Guarantee rights.
  • 15. The Device delivered by the Person entitled by the Guarantee to the Guarantor shall be properly secured and protected against damages during transport. Proper protection and means an original, manufacturer’s packaging with all securities (lock) existing when the Device is received by the Person entitled by the Guarantee from the Guarantor. In case of the failure by the Person entitled by the Guarantee to use the manufacturer’s packaging of the Device with the above mentioned securities, the Person shall bear all risk related to the damages of the Device delivered to the Guarantor.
  • 16. For issues within any scope not regulated by these Guarantee Conditions, the provisions of the Civil Code shall apply, and in particular, the provisions of articles 577–581.
  • 17. The Guarantee does not exclude, limit, or suspend the warranty rights for the defects of a sold product to which a Client who has purchased the Device from the Seller is entitled.

GUARANTEE AND POST-GUARANTEE REPAIRS TERMS AND CONDITIONS

Guarantee repairs

  • The Service performs guarantee repairs in accordance with the device guarantee terms and conditions.
  • The Client reports the device covered by a manufacturer’s guarantee to a dedicated manufacturer’s helpline or to the Service by completing a report form available at www.rgbelektronika.pl
  • The Client delivers a device covered by the guarantee to the Service in a way agreed with the Service: as insured courier-delivered package at the Service’s cost, by Service’s own transport, or delivered to the Service’s site.
  • In order to confirm the guarantee, the Client is obliged to present necessary documents specified in the guarantee conditions delivered with a purchased product. Failure to provide the documents confirming that a product is covered by the guarantee will result in a repair treated as a paid repair at a price according to the Service Price List. If proper documents are provided, the time for repair shall be counted from the day of documents delivery from the Client.
    Only in case of discrepancies between the guarantee period provided in the guarantor’s system and a period resulting from a purchase document, the Client is obliged to present the proof of purchase with a device serial number.
  • Guarantee repairs are performed by the Service free of charge, except for cases specified in the guarantee terms and conditions. The Service reserves the right to refuse to recognize a free of charge guarantee repair if:
    • products have been altered by unauthorized entities;
    • devices have been mechanically damaged;
    • found damage results from the usage beyond the scope of usage for the devices described and/or provided in the instructions for use (when such instructions have been provided with a device);
    • guarantee seal has been altered in any way by unauthorized entities;

In such a case, the Client is entitled to file a repair cancellation declaration or post-guarantee repair order pursuant to the conditions specified in Part II of these Terms and Conditions.

  • To the parts or devices replaced in the process of repair, the Service grants a guarantee on the basis of the guarantee terms and conditions.
  • Any other issues related to the guarantee repairs not included in these Terms and Conditions shall be regulated by the device guarantees.
